Terms of Use of Location-Based Services

1. Purpose

These Terms aim to clearly define the rights, obligations, and responsibilities of the member ("Member" or "you") and Studiokico Inc. ("Company," "we," or "us") concerning the use of the Weevee Location-Based Services (the "Service").


2. Effect and Amendment of Terms


These Terms become effective when the Member agrees to them upon signing up for the Service and is registered as a user in accordance with the Company's established procedures.

The Company posts these Terms on the initial screen of the Service or through a separate linked screen for easy access by the Member.

The Company may amend these Terms to the extent that they do not violate the Act on the Protection and Use of Location Information (the "LBS Act") and other applicable laws.

If the Company amends the Terms, it will provide notice of the current terms, the amended terms, the effective date, and the reasons for the amendment from 7 days prior to the effective date. For amendments that are unfavorable to the Member, notice will be provided 30 days in advance and delivered individually via email or other means.

If the Member does not express an explicit refusal within 7 days of the notice described in the preceding paragraph, they will be deemed to have agreed to the amended Terms. If a Member does not agree to the amended Terms, they may terminate the user agreement.


3. Governing Rules

Any matters not specified in these Terms shall be governed by the LBS Act, the Personal Information Protection Act, the Act on Promotion of Information and Communications Network Utilization and Information Protection, etc., other applicable laws, the Company's general Terms of Use, its Privacy Policy, and any other guidelines set forth by the Company.

5. Service Fees

The Service is provided free of charge by default. However, separate paid services may only be used upon payment of the specified fees.

Fees for paid services may be charged through methods designated by the Company or via a third-party payment processor.

The cancellation and refund policy for payments made for paid services shall be in accordance with applicable laws and the Company's payment-related terms.


6. Notification of Service Changes

If the Company changes or terminates the content of the Service, it will provide notice 30 days in advance via the Member's registered email address or through a notice within the Service for an unspecified number of users.

The Company may restrict or suspend a Member's use of the Service in any of the following cases:


8. Use and Provision of Personal Location Information

The Company must obtain the Member's consent in advance, as specified in these Terms, to provide the Service using personal location information.

If providing a Member's personal location information to a third party designated by the Member, the Company will notify the Member of the recipient and purpose in advance and obtain consent.

When providing personal location information to a third party in accordance with Paragraph 2, the Company will immediately notify the Member of the recipient, the date, and the purpose of the provision each time via the Member's communication device or email. However, notifications may be collected and sent in 30-day batches if previously arranged by the Member.

The Company will not use or provide personal location information to third parties beyond the scope of the purpose of providing the Service without the Member's consent.


9. Retention and Use Period of Personal Location Information

In accordance with the LBS Act, the Company shall record and preserve data confirming the use and provision of location information for 1 year.

Other personal location information is, in principle, destroyed without delay once its purpose of use is achieved or upon the Member's withdrawal of consent. However, location information saved with a Member's post will be retained for the duration of that post.

If a Member suffers damages due to an act by the Company that violates the LBS Act, the Member may claim compensation from the Company. In such a case, the Company cannot be exempted from liability unless it can prove the absence of intent or negligence.


12. Disclaimer of Liability

The Company shall not be liable for any damages incurred by the Member if the Service cannot be provided due to any of the following reasons:


13. Dispute Resolution

If a dispute arises in connection with the use of the Service, the Company will consult in good faith with the Member to resolve the dispute.

If a dispute is not resolved through the foregoing consultation, both parties may apply for mediation or dispute resolution to the Korea Communications Commission (KCC) or the Personal Information Dispute Mediation Committee in accordance with the LBS Act.

If the dispute is still not resolved, both parties may file a lawsuit in a court of competent jurisdiction under the Civil Procedure Act.

14. Location Information Manager

The Company has designated a Location Information Manager to properly manage and protect personal location information and to handle the complaints of data subjects smoothly.
